Terms of Service

These Terms of Service ("Terms") govern your use of thepickleballindex.com (the "Service"), operated by The Pickleball Index Inc. ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

The Pickleball Index is a discovery platform for pickleball events, gear, pros, and clubs. The Service provides a searchable index of pickleball-related listings, map-based discovery, open play schedules, and tools for organizers and players to submit and manage content.

2. Account Registration

To access certain features, you must create an account. When you register, you agree to:

• Provide accurate and complete information
• Maintain the security of your password and account credentials
• Not share your account with others or create multiple accounts
• Notify us promptly of any unauthorized access to your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription Tiers and Billing

The Service offers four tiers: Free, Verified, Pro, and Enterprise. The Free and Verified tiers are available at no cost. Pro and Enterprise tiers require a paid subscription billed monthly or annually through Stripe.

• Prices are displayed on our Pricing page and are subject to change with 30 days' notice
• Subscriptions automatically renew at the end of each billing period unless cancelled
• All fees are in US dollars and are non-refundable except as described in Section 4

4. Cancellation and Refunds

You may cancel your paid subscription at any time through the Stripe customer portal accessible from your dashboard. Upon cancellation:

• You retain access to your paid tier features through the end of your current billing period
• Your account reverts to the Free tier when the paid period expires
• Your data, listings, and profile are preserved at the Free tier

Refunds are generally not provided for partial billing periods. If you believe you have been charged in error, contact us at justin@thepickleballindex.com within 14 days of the charge.

Billing Disputes: If you have a question or dispute regarding a charge, please contact us at justin@thepickleballindex.com before initiating a chargeback with your bank so we can help resolve the issue directly.

5. User-Submitted Content

You may submit listings, images, text, and other content to the Service ("User Content"). By submitting User Content, you:

• Retain ownership of your content
• Grant The Pickleball Index Inc. a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Service
• Represent that you have the right to submit the content and that it does not infringe on the rights of any third party
• Acknowledge that submitted content may be reviewed, edited, or removed at our discretion

You agree not to submit content that:

• Is false, misleading, or inaccurate
• Infringes on intellectual property rights of others
• Contains spam, advertising, or promotional material unrelated to pickleball
• Is defamatory, harassing, or otherwise objectionable
• Violates any applicable law or regulation

6. Claims

The Service allows users to claim ownership of person or organization profiles. Claims are subject to administrator review and approval. By submitting a claim, you represent that you are the person depicted or an authorized representative of the organization. False claims may result in account suspension or termination.

7. Intellectual Property

The Service, including its design, branding, logo, code, and compiled data, is owned by The Pickleball Index Inc. and protected by copyright and other intellectual property laws. You may not:

• Copy, reproduce, or redistribute the Service or its content beyond personal use
• Scrape, crawl, or use automated means to extract data from the Service without written permission
• Use our trademarks, logos, or branding without authorization
• Create derivative works based on the Service

8. Prohibited Conduct

When using the Service, you agree not to:

• Attempt to gain unauthorized access to other users' accounts or our systems
• Use automated scripts, bots, or other tools to interact with the Service
• Impersonate another person or entity
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any illegal purpose
• Circumvent or attempt to circumvent any access restrictions or rate limits

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• The Service will be uninterrupted, timely, or error-free
• Listing information submitted by users or imported from third-party sources is accurate or complete
• The Service will meet your specific requirements

10. Limitation of Liability

To the maximum extent permitted by law, The Pickleball Index Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Pickleball Index Inc. and its officers, directors, and employees from and against any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

Either party may terminate your account at any time. We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms. Upon termination:

• Your right to access the Service ceases immediately
• We may retain or delete your data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination (including Sections 7, 9, 10, 11, and 13) will remain in effect

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in the State of New York, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the Service.
